I suggest we prop up a flimsy legal agreement here that allows us at least some semblance of a legal defence.

In short, we lock the forum downloads to registered users only, forum text itself being open to everyone. In the registration, use phpBB's Terms of Service and User Agreement pages to lay out some disclaimers, which will at least let administration respond to any legal notices that our users agree to our terms of service to be responsible for any content they upload or download and their usage of it.

The fine print we can work out in discussion here but I suggest this as a bare minimum step to prevent another upheaval like the one we've just witnessed from happening again.

Unfortunately, from a legal standpoint, I believe that any attempt to mitigate risk by shifting responsibility by way of disclaimers and 'checkbox' agreements will do very little beyond setting our minds at ease while only fooling ourselves.
